Terms of service

These general terms and conditions of sale govern the contractual relations between Esprit Padel Shop and its customers. Any order confirmed by the consumer implies their unreserved acceptance of these general terms and conditions of sale. These terms are subject to change by Esprit Padel Shop. In this case, the applicable conditions will be those in force on the website at the time the order is confirmed by the consumer.

 These terms and conditions apply from 18 May 2011.

ARTICLE 2: CONTRACTUAL INFORMATION

 In accordance with the provisions of the French Consumer Code, the online shop set up by Esprit Padel Shop within the framework of its website provides the following information:

 - Legal notice allowing precise identification of Esprit Padel Shop;

- A description of the essential characteristics of the goods offered;

- An indication in euros, all taxes and charges included, of the price of goods and services and delivery costs;

- An indication of payment, delivery or execution costs;

- The validity of the offer and its price;

- The existence of a right of withdrawal.

 All information on the www.esprit-padel-shop.com website is presented in French.

ARTICLE 3: PRODUCTS

 a. Prices

 The prices of our products on the website are indicated in euros, all taxes included, excluding delivery costs. They apply upon order confirmation by the consumer (subject to availability). 

 It should be noted that if items display an incorrect price on the Esprit Padel Shop website (e.g. a racket at 4 euros), Esprit Padel Shop reserves the right not to deliver the customer and this order will be cancelled or returned to Esprit Padel Shop by the customer if it was delivered in error.

Depending on the order amount and delivery destination, shipping costs may be added to the order total.

Prices are subject to French VAT, and any change in the statutory rate of this VAT will automatically be reflected in the prices of products displayed on the Esprit Padel Shop website on the date stipulated by the relevant implementing decree.

The displayed retail prices correspond to the recommended retail prices provided by the manufacturers.

 b. Availability

The offers presented by Esprit Padel Shop are only valid while stocks last. In the event of unavailability and in accordance with Article L 121-20-3 of the French Consumer Code, you will be informed by email or telephone of any items that are out of stock.

The buyer will then have 72 working hours (excluding Saturdays, Sundays and public holidays) from the date of purchase to request cancellation, refund of sums collected or exchange of their order up to an equivalent total price by contacting us by email at contact@esprit-padel-shop.com

After this period, if no request is made by you, your order will be sent to you with the available items and you will only be charged for those items.

 Unavailable items will be refunded using the payment method used by the customer to pay for their order.

 The customer may reserve goods on order from our suppliers. If the order is incomplete, Esprit Padel Shop reserves the right to dispatch the goods once all items in the order are in stock. The customer may request immediate delivery of the incomplete order from Esprit Padel Shop, subject to paying the shipping costs for the second dispatch.

 c. Conformity of product offers

 The products offered comply with current French legislation and the standards applicable in France. 

In accordance with Article L 111-1 of the French Consumer Code, consumers have the option to know the essential characteristics of the products they wish to purchase before placing a definitive order.

Professional players may play with racket specifications that differ from those displayed.

 d. Discount codes and gift vouchers

 Discount codes: Simply enter the code in the "discount voucher" bar at the top of your basket, and the discount will be applied immediately. Please note that discount codes cannot be combined and always have a validity period.

 

ARTICLE 4: THE ORDER

 a. Placing the order

 These general terms and conditions of sale come into effect on the date of signature of the purchase order on our website www.esprit-padel-shop.com. In accordance with the French LEN law of 21 June 2004, you have the option to check the order details and total price (price in euros including all taxes and charges, plus products and delivery costs) and correct any errors before confirming it to express your acceptance.

Esprit Padel Shop will acknowledge receipt of your order electronically without delay.

 b. Transfer of ownership

Esprit Padel Shop retains full and complete ownership of the products sold until full payment of all sums due by the consumer in the context of their order, including costs and taxes. 

The transfer of ownership of a product purchased on www.esprit-padel-shop.com by the consumer to a third party will not be supported by Esprit Padel Shop. Only the original buyer of this product may claim rights under the clauses of these general terms and conditions of sale.

 c. Proof of the transaction

 Purchase orders and invoices will be archived on a reliable and durable medium that can be legally produced as evidence.
