ARTICLE 1: PURPOSE

These general terms and conditions of sale govern the contractual relationship between Esprit Padel Shop (SIREN: 891931172) and its customers. Any order confirmed by the consumer implies their unreserved acceptance of these general terms and conditions of sale. These terms are subject to change by Esprit Padel Shop. In this case, the applicable terms will be those in effect on the site at the time the order is confirmed by the consumer.

 These general terms and conditions apply from 18 May 2011.

ARTICLE 2: CONTRACTUAL INFORMATION

 In accordance with the provisions of the French Consumer Code, the online shop set up by Esprit Padel Shop on its website provides the following information:

 - A legal notice allowing accurate identification of Esprit Padel Shop;

- A presentation of the essential characteristics of the goods offered;

- An indication in euros inclusive of all taxes and charges of the price of the goods and services and delivery charges;

- An indication of payment, delivery or execution costs;

- The validity of the offer and its price;

- The existence of a right of withdrawal.

 All information on the www.esprit-padel-shop.com website is presented in French.

In accordance with the provisions of the French Consumer Code concerning "the consumer dispute mediation process", after contacting us and in the absence of a satisfactory response, you have the option of having free recourse to a consumer mediation procedure with:

ARTICLE 3: PRODUCTS

 a. Prices

 The prices of our products on the site are indicated in euros inclusive of all taxes and charges, excluding delivery costs. They apply upon confirmation of the order by the consumer (subject to availability). 

 It should be noted that if items have an inconsistent price on the Esprit Padel Shop website (e.g. a racket at 4 euros), Esprit Padel Shop will be entitled not to deliver to the customer and this order will be cancelled or returned to Esprit Padel Shop by the customer if it had been delivered by mistake.

Depending on the order amount and the shipping destination, shipping fees may be added to the total order amount.

Prices are subject to French VAT for deliveries in France. Any change in the legal rate of this VAT will implicitly be reflected in the prices of the products presented on the Esprit Padel Shop website on the date stipulated by the relevant application decree.

For orders within the European Union, prices are subject to the VAT of the respective countries. Any change in the legal rate of this VAT will implicitly be reflected in the prices of the products presented on the Esprit Padel Shop website on the date stipulated by the relevant application decree.

For orders outside the European Union, prices are not subject to VAT.

Prices update automatically based on your delivery address.

The displayed public prices correspond to the recommended retail prices by the manufacturers.

 b. Availability

The offers presented by Esprit Padel Shop are only valid while stocks last. In case of unavailability and in accordance with Article L 121-20-3 of the French Consumer Code, you will be informed by email or phone of the items that are out of stock.

The purchaser will then have 72 working hours (excluding Saturdays, Sundays, public holidays or non-working days) from the date of purchase to request cancellation, refund of the sums received or exchange of their order up to the limit of an equivalent total price by contacting us by email at contact@esprit-padel-shop.com

After this period and if no request is made by you, your order will be sent to you with the available items and only these items will be charged to you.

 Unavailable items will be refunded using the payment method used by the customer to pay for their order.

 Customers have the option to reserve goods on back-order from our suppliers. In the event that the order is incomplete, Esprit Padel Shop reserves the right to dispatch the goods once all items in the order are in stock. The customer may request immediate delivery of the incomplete order from Esprit Padel Shop, subject to paying the shipping costs for the second shipment.

 c. Conformity of product offers

 The products offered comply with current French legislation and standards applicable in France. 

In accordance with Article L 111-1 of the French Consumer Code, the consumer has the opportunity to learn about the essential characteristics of the products they wish to purchase before placing a final order.

Professional players may play with racket specifications different from those displayed.

 d. Discount codes and gift vouchers

 Discount codes: Simply enter the code in the "discount coupon" bar located at the top of your basket, and the discount will be applied immediately. Please note that discount codes cannot be combined and always have a validity period.

 

ARTICLE 4: THE ORDER

 a. Placing an order

 These general terms and conditions of sale take effect on the date of signing the order form on our website www.esprit-padel-shop.com. In accordance with the French LEN law of 21 June 2004, you have the opportunity to check the details of your order and its total price (price in euros inclusive of all taxes and products plus delivery costs) and to correct any errors before confirming it to express your acceptance.

Esprit Padel Shop will acknowledge receipt of your order electronically without delay.

 b. Transfer of ownership

Esprit Padel Shop retains full and complete ownership of the products sold until full payment of all amounts due by the consumer within the framework of their order, including costs and taxes. 

The transfer of ownership of an item purchased on www.esprit-padel-shop.com by the consumer to a third party will not be handled by Esprit Padel Shop. Only the original purchaser of this item may claim the benefit of the clauses of these general terms and conditions of sale.

 c. Proof of transaction

 Order forms and invoices will be archived on a reliable and durable medium that can be legally produced as proof.

ARTICLE 6: DELIVERY

a. Delivery:

Esprit Padel Shop delivers its products in mainland France and overseas territories, to European Union countries, and to all non-EEC countries. Products will be delivered to the address indicated by the consumer on the order form.

Additional shipping costs may apply for deliveries outside mainland France.

In the case of an order invoiced excluding VAT by Esprit Padel Shop, the consumer may be required to pay VAT and customs duties to the carrier upon delivery.

Placed orders are dispatched within 24 to 48 working hours following the order by the carrier chosen by the customer at the time of ordering (excluding Fridays, Saturdays, Sundays and public holidays).

Shipments in France:

For COLISSIMO deliveries in mainland France, a fixed contribution of €6.90 towards shipping costs is requested for any order not exceeding 200 euros.

The indicative delivery time is 2 working days from the dispatch date. Allow 1 to 2 working days for package preparation in our warehouses.

This delivery contribution increases to 8.90 euros (no free delivery threshold) for delivery via Chronopost.

For pick-up point deliveries in mainland France, a fixed shipping contribution of €3.90 is requested for any order not exceeding 80 euros.

For heavy items (cases of balls, for example), a variable surcharge is applied depending on the delivery country without any free shipping threshold. Delivery charges apply systematically and pick-up point delivery is not available.

For shipments to French overseas territories: we use the DHL service (indicative delivery time of 5 to 7 working days)

The consumer has the legal and contractual obligation to check the physical condition and contents of the parcel(s) upon delivery in the presence of the delivery driver.

All orders outside mainland France may be subject to different shipping costs.
